HJRCA 20 resolves by the Illinois House of Representatives, with the concurrence of the Illinois Senate, that there must be submitted to the electors of the state for adoption or rejection at the general election next occurring at least six months after adoption of the resolution a proposition to repeal Article XIII, Section 5 of the Illinois Constitution.
Specifically, HJRCA 20 repeals the “Pension and Retirement Rights” section of the Illinois Constitution (Article XIII, Section 5). This section provides that membership in any pension or retirement system of the state, any unit of local government or school district, or any agency or instrumentality thereof, must be an enforceable contractual relationship, the benefits of which must not be diminished or impaired.
HJRCA 20 takes effect upon being declared adopted in accordance with Section 7 of the Illinois Constitutional Amendment Act.
HJRCA 20 is identical to HJRCA 19 of the 101st General Assembly.
